These terms apply to the en3 mobile app, the en3 website, and your en3 account.
1. Who we are, and what these terms do
en3 is a membership and competition platform operated by NUMBERS VENTURES LIMITED (RC 9638874), a company registered in Nigeria at Plot 598 CAD Zone 07, Citizen Avenue, Dawaki, FCT, Nigeria 900108 ("we", "us"). "You" means the person using en3.
These terms are a contract between you and us. They apply when you create an en3 account, use the en3 mobile app, or use the en3 website. By creating an account you accept them. If you do not accept them, do not use en3.
Your privacy matters as much as these terms: the en3 Privacy Policy explains how we handle your personal data, and the en3 Cookie Policy covers analytics and cookies. Both are part of the picture but are separate documents.
Nothing in these terms takes away rights that Nigerian consumer protection law gives you and does not let you give up.
2. What en3 is
en3 lets you:
- (a) join membership programmes run by businesses on the platform and hold digital membership cards;
- (b) discover businesses near you;
- (c) enter competitions hosted by businesses on the platform — skill-based tournaments, some of which charge an entry fee and offer prizes.
Businesses on en3 run their own membership programmes and host their own competitions. When you join a business's programme or competition, that relationship is between you and the business; we provide the platform it runs on.
3. Your account
- (a) You must be at least 18 years old to create an account.
- (b) Give us accurate information and keep it up to date.
- (c) Your account is personal. Keep your sign-in access secure, and tell us promptly if you think someone else has used your account.
- (d) Do not create multiple accounts to gain an unfair advantage — for example to enter the same competition twice or to abuse promotions.
- (e) You can close your account at any time in the app under Account settings. Section 11 explains what happens then.
4. Identity verification
For some features — including entering certain competitions — we may require you to verify your identity with a government-issued ID and a selfie, through our verification provider. If you choose not to verify, those features stay unavailable, but the rest of en3 keeps working. The Privacy Policy explains how verification data is handled.
5. Memberships, fees and auto-renewal
- (a) Membership plans, their prices and their billing period are shown to you before you pay. Prices are in Nigerian Naira unless stated otherwise.
- (b) Paid memberships renew automatically at the end of each billing period, at the price shown when you subscribed, until you cancel.
- (c) You can cancel at any time in the app. Cancelling stops future charges; your membership stays active until the end of the period you have already paid for.
- (d) If a business or we change a plan's price, the new price applies from your next renewal, not retroactively, and you will be told before it takes effect.
- (e) Payments are processed by our payment provider. We never receive your full card number.
6. Competitions, entry fees and prizes
- (a) Competitions on en3 are hosted by businesses on the platform (the "organizer" — the business running the competition). The entry fee, the prize, the format and the schedule are shown before you enter.
- (b) Entry fees are payable when you enter. We collect them through the platform on the organizer's behalf. Once a competition has started, entry fees are not refundable except as Section 7 or the law requires.
- (c) Competitions on en3 are skill-based. You compete on performance, not chance.
- (d) You must be 18 or older to enter a competition with an entry fee or a prize.
- (e) Play fairly. Cheating, collusion, exploiting bugs, or entering under multiple accounts can lead to disqualification, forfeiture of prizes from the affected competition, and action under Section 10.
- (f) If you fail to play a scheduled match without a valid reason, the match may be forfeited under the competition's format rules.
- (g) Prizes are offered, described and delivered by the organizer, not by us. We do not hold, guarantee or pay out prizes. If an organizer does not deliver a prize as described, your claim is against that organizer — and report it to us too: we review businesses before they join the platform, and we act on reports, including by suspending or removing an organizer.
- (h) A competition's rules may require identity verification (Section 4) before you can enter or receive a prize.
- (i) If a competition is cancelled before it starts, entry fees for it are refunded in full.
7. Refunds
- (a) If we charge you in error, or you pay for something we then fail to provide, we will refund you.
- (b) Cancelling a membership stops future renewals; amounts already paid for the current period are not refunded unless the service was not provided or the law requires a refund.
- (c) To ask for a refund, contact support in the app or at [email protected]. Tell us what happened; we will respond within a reasonable time and explain our decision.
- (d) Nothing in this section limits your rights under Nigerian consumer protection law.
8. Acceptable use
Do not:
- (a) break the law, or use en3 to harm, defraud, harass or impersonate anyone;
- (b) cheat in competitions or interfere with other users' play;
- (c) upload content that is unlawful, or that you have no right to share;
- (d) probe, overload, scrape or attempt to break the security of the platform, or access data that is not yours;
- (e) copy, resell or reverse-engineer the platform, except where the law allows it regardless of this clause.
9. Content and intellectual property
- (a) en3 — the apps, the design, the software, the brand — belongs to us and our licensors. We give you a personal, non-transferable right to use the apps to access the service while these terms apply. We are not selling you the software.
- (b) Content you submit (for example a profile photo or a support message) stays yours. You give us the permission we need to host, display and process it to run the service.
- (c) If you send us feedback or suggestions, we may use them without owing you anything.
10. Suspension and ending access
- (a) We may suspend or restrict your account, or end it, if you materially breach these terms, if we reasonably suspect fraud or cheating, or if the law requires us to.
- (b) Unless the delay would cause harm we cannot undo, we will tell you what the problem is and give you a chance to respond before we act, and our response will be proportionate to the issue.
- (c) Ending your account does not take away rights you already have — including refund rights under Section 7 and your statutory consumer rights.
11. Closing your account
You can request account deletion in the app at any time. Deletion is handled as described in the Privacy Policy, including the grace period during which you can change your mind. These terms end when your account is deleted, except the parts that by their nature continue (for example Sections 12–14 and any amounts owed).
12. Service availability and disclaimers
- (a) We work to keep en3 available and safe, but we provide it "as is": we do not promise it will be uninterrupted or error-free, and features may change, be added, or be turned off as the platform evolves.
- (b) We are not a party to the membership relationship between you and a business on the platform, or to an organizer's prize obligations (Section 6), and we are not responsible for a business's own goods, services, prizes or conduct — though we review businesses before they join the platform and act on reports of misuse.
- (c) This section does not exclude anything Nigerian law does not let us exclude, including your statutory consumer rights.
13. Our liability
- (a) Nothing in these terms excludes or limits our liability for fraud, for death or personal injury caused by our negligence, or for anything else the law does not allow us to exclude or limit.
- (b) Apart from clause (a): our total liability to you for all claims arising out of or connected with en3 in any 12-month period is limited to the total amount you paid us in fees in that period.
- (c) Apart from clause (a): we are not liable for losses that were not a foreseeable result of our breach — for example loss of profit from uses of en3 we could not reasonably have expected.
- (d) Apart from clause (a): where a business on the platform fails to deliver a prize, product or service it owes you, your claim is against that business (Sections 2 and 6); we are not liable for it.
14. Your responsibility to us
If your unlawful use of en3, or your breach of these terms, causes a third party to bring a claim against us, you will cover the losses and reasonable costs that claim causes us. This does not apply to the extent the claim results from our own breach or negligence.
15. Changes to these terms
- (a) We may update these terms. Each version has a version number and an effective date.
- (b) For material changes we will notify you — in the app or by email — before the new terms take effect, and where the law requires it we will ask you to accept them again.
- (c) If you do not accept a material change, you can close your account before the change takes effect; Section 11 then applies.
16. Governing law and disputes
- (a) These terms are governed by the laws of the Federal Republic of Nigeria.
- (b) If something goes wrong, talk to us first — in-app support or [email protected]. Most problems are fixable without lawyers.
- (c) Disputes that we cannot resolve together go to the courts of Nigeria. You may also have the right to complain to the Federal Competition and Consumer Protection Commission (consumer matters) or the Nigeria Data Protection Commission (data matters); these terms do not limit those rights.
17. General
- (a) If part of these terms turns out to be unenforceable, the rest still applies.
- (b) If we do not enforce a clause immediately, we have not given it up.
- (c) We may transfer this contract as part of a business transfer; your rights under it are preserved. You may not transfer your account to someone else.
- (d) These terms, the Privacy Policy, the Cookie Policy and the rules shown for a specific competition or plan are the whole agreement between you and us about en3.
